Utah Health Care Directive or Health Care Power of Attorney – Do you really need one?

So it seems that too many people have questions about Health Care Directives (they are also called Living Wills or Health Care Powers of Attorney).

I was asked by a new client — > Do I really need a health care power of attorney?

Answer – Well, yes, of course you do.

Unless of course, you want to be held captive to hospitals and doctors who will profit at you being brain-dead, on life support, and them keeping you alive for as long as your insurance will pay (or as long as you have assets that can cover the costs) (or as long as the government will foot the bill for).

Yes, I know I’m a little crass sometimes, but hey, this is the truth my friends.

I mean, come one, you don’t want to be stuck in a hospital any longer than you have to be, right?  And if you are like me, when I’m braindead, when my mind is gone, when I’m only alive because a machine keeps me alive, then pull the plug because I don’t want that kind of life.  Most of my clients don’t want that either.

We all want to feel good.  Live a long life.  Live a functional life, as long as we can do so.

I’ve never met anyone who’s said to me — Mike, I don’t want them to pull the plug.  Or Mike, make sure they keep me on a ventilator for as long as possible.

NOOOOO!!!!

You wouldn’t either.  Am I right?

Some people hate to admit the truth — sometimes you just have to get your life in order.  Sometimes you just have to take care of business.  You know, like doing your estate planning, before it’s too late.

Let me tell you about the estate plan I finished up today.

A widow.

91 years old.

Husband died about a month ago.

Husband had no will.

Husband had no trust.

My client is lonely.

My client is tired.

My client wishes this was all taken care of years ago…

but you know, it’s IMPORTANT, but it wasn’t URGENT.

I had a great meeting with a couple in my office today.

They are the type of people that will remind you of your parents.

Just good and wholesome folks.

They were told they needed to do estate planning and had a question about a power of attorney.

So I decided to do a quick video to explain what a power of attorney is.

So in this video I explain what a power of attorney is, how it works and why you need one in your estate plan.  You ought to have a power of attorney.  For estate planning purposes, the power of attorney (POA) needs to be a durable POA, or one that works when you are not able to make decisions on your own.

The main decisions you need to be able to make are (1) financial decisions and (2) health care decision.  With a proper power of attorney, you’re not going to miss a house payment, a utility payment, or have trouble with the bank or credit union when you have incapacity issues show up.
